Regulations from Government prescribed new model articles of association for Right to Manage Companies from the 9th November 2009.
These regulations replaced RTM Memorandum and Articles Regulations 2003 (SI 2003/2120).
The reason for the change was that the Companies Act 2006 had changed the way that companies can operate and so the articles for RTM Companies needed to be updated.
Any RTM Company formed from 9th November 2009 have to use the new model articles when applying to Companies House.
All RTMs Companies formed prior to 9th November 2009 had their memorandums changed by law to the new model articles as from 30th September 2010, whether they voted to change their articles or not.
New regulations came into force in Wales on 30 November 2011. These are known as The RTM Companies (Model Articles) Wales Regulations 2011.
The regulations are not about resident management companies in general; only Right to Manage Companies.
